Regulation on maximum levels of emissions for brand new vehicles up to 14,000 pounds and higher

Ministry of Environment proposed a draft of NOM-076-SEMARNAT-1995 regulating maximum allowed levels of emission for unburned hydrocarbons, carbon monoxide and nitrogen oxides from the exhaust, as well as evaporation hydrocarbons from the fuel system, which use gasoline, liquefied petroleum gas, natural gas and other alternative fuels and to be used for motor vehicles with gross vehicle weight greater than 3,857 kilograms (around 8503 pounds).

This Mexican Standard (Norma Oficial Mexicana or NOM) was originally issued on December 25, 1995, but on March 29, 2011, National Committee for Mexican Standards for Environmental Issues approved this Draft, and granted until November 27, 2011 for third parties to provide comments.

This new NOM will be applicable for manufacturers, importers and assemblers of new engines of vehicles with a gross vehicle weight greater than 3,857 kg., as well as brand new vehicles with that kind of engines.

The gross vehicle weight is calculated by adding the weight of the vehicle plus the maximum capacity of charge plus full tank.

Manufacturers, importers and assemblers will be required to certify compliance with the new NOM, resulting from a test made by a lab with authorisation from the Mexican Environmental Agency (PROFEPA).

The tests to be used are Transitory Cycle and FTP75 Cycle on new vehicles in three categories: (a) Weight from 3,857 to 6,350 kg. (14,000 Pounds), (b) Weight higher than 6,350 kg, and (c) “Complete” new vehicles from 3,857 to 6,350 kg., defined as special-purpose vehicles.

NOM certification has to be requested before PROFEPA before importing, distributing or selling. Certification shall be issued per family of engines, and will remain in force until the standards are changed.

Under Improvement Regulation Law, importers, manufacturers and traders may openly discuss the regulation on levels of emission for vehicles face to face with the authorities, under the corresponding proceeding for legal lobbying of private parties.
